Nestle seems to have won one, and lost two, cases over whether it can trademark a shape. Many times you can. (For example, the shape of the Coca-Cola bottle.) In this particular case, it would seem to be complicated by possible prior art, in that a couple of companies were using the same shape before Nestle did.
Nestle says they aren't finished yet, so stand by for the final (?) judgement ...
